General German Forwarding Agent Conditions (ADSp) 2003 and 2016
We work exclusively according to the German Freight Forwarders' Standard Terms and Conditions - ADSp - and as far as these do not apply to the provision of logistical services - according to the Logistics Terms and Conditions - latest version. Clause 23 ADSp limits the legal liability for damage to goods in accordance with §431 HGB, for damage whilst in the care of a forwarder to € 5.00 per kg; in the case of multimodal transports, including sea transport to 2 SDR (special drawing rights)/kg and in addition thereto to € 1 million or € 2 million per claim or event or 2 SDR/kg whichever is the greater. In addition it is agreed that section 27 ADSp neither extends the liability of the freight forwarder nor the attribution of blame to persons or other third parties in derogation of legal provisions such as Art. 25 MÜ, Art. 36 CIM, Art. 21 CMNI, §660 HGB in favour of the principal. For heavy lift orders we work on the basis of the General Terms and Conditions of the Federal Professional Group for Heavy Lift and Crane Work (BSK).

We work exclusively on the basis of the Allgemeine Deutsche Spediteurbedingungen 2016 (ADSp 2016). The ADSp 2016 limits in paragraph 23 the legal liability for damage to goods in the amount of 8.33 SDR/kg per claim or event to 1 million or 2 million Euro or 2 SDR/kg, whichever is the greater, and in general to 2 SDR/kg in the case of multimodal transports, including sea transport.
